1. Introduction
Welcome to App My Cloud, a leading SaaS platform operated by Martin Matatko (87317796), located in the Czech Republic. By accessing or using our platform (https://AppMyCloud.com), you agree to comply with these Terms & Conditions. These terms apply to all visitors, users, and others who access or use the platform.
2. Services
App My Cloud provides developers with robust tools to deploy applications to cloud environments using Flatcar Linux and Docker images. Users can create Butane configurations, organize VM configurations into projects, and apply predefined templates. We reserve the right to modify or discontinue any feature or service at any time without prior notice.
3. Accounts
Users must log in using their GitHub account. We only collect the primary email from GitHub for account purposes. Users are responsible for maintaining the confidentiality of their account information and for all activities that occur under their account. If you suspect any unauthorized use of your account, you must notify us immediately.
4. Free and Paid Plans
We offer a free plan with certain limitations, including the creation of one VM under one project with a maximum of 1000 configurations per month. Paid plans, such as Pro and Unlimited, are available with expanded features. Details of the available plans and their features are provided on our pricing page. We reserve the right to change the features or pricing of any plan at any time.
5. User Responsibilities
Users are solely responsible for the software they deploy using our platform, including ensuring the security, legality, and compliance of their cloud deployments, monitoring, and Service Level Agreements (SLAs). Users agree not to use the platform for any illegal or unauthorized purposes. You must comply with all applicable laws and regulations regarding your use of the platform.
6. Liability
App My Cloud is not liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of data, profits, or revenue, arising out of the use of or inability to use the platform, even if we have been advised of the possibility of such damages. We do not warrant that the platform will be uninterrupted, error-free, or completely secure.
7. Payments
Payments for paid plans are processed through Paddle, which acts as the Merchant of Record (MoR). By subscribing to a paid plan, you agree to Paddle's payment terms, which include applicable taxes and fees. All subscriptions are automatically renewed at the end of their billing period unless canceled before the renewal date.
8. Termination
We reserve the right to terminate or suspend your access to the platform at our sole discretion, without prior notice or liability, for any reason whatsoever, including but not limited to a breach of these Terms & Conditions. Upon termination, your right to use the platform will immediately cease. If you wish to terminate your account, you may simply discontinue using the platform.
9. Governing Law
These terms are governed by and construed in accordance with the laws of the Czech Republic, without regard to its conflict of law principles. Any disputes arising out of or relating to these terms or the platform will be subject to the exclusive jurisdiction of the courts located within the Czech Republic.
